CONSULTATION TERMS & ACKNOWLEDGEMENTS

These Terms & Conditions ("Terms") govern your access to and use of this website and any related content, including artwork, commissions, programs, subscriptions, digital products, courses, video libraries, consulting, in-person or virtual sessions, and physical products (collectively, the "Work"). This website and all Work are operated by Monica Vivar, doing business as Sisne Senne Studio, an independent sole proprietorship based in Toronto, Ontario, Canada ("we," "us," or "our").

Definition of Work: Work encompasses all tangible and intangible creations or engagements produced and offered by this independent, sole proprietor practice. This includes physical artwork, limited editions, prints, commissioned work, digital content, educational materials, courses, video libraries, subscription-based access, patronage offerings, consulting, strategy sessions, and any in-person or virtual professional or creative engagements.

By accessing this website or purchasing any Work, you agree to be bound by these Terms. These Terms are written to be clear, fair, honourable, and protective of both you as the client and the independent creator operating this practice. We reserve the right to revise these Terms from time to time in light of best practices and evolving offerings; your continued use of the website or Work constitutes acceptance of any such updates.

1. About the Practice

This website and all Work are operated by an independent sole proprietor based in Toronto, Ontario, Canada ("we," "us," or "our"). The practice operates at the intersection of art, entrepreneurship, strategy, and lived professional experience.

2. Nature of the Work

You acknowledge and agree that:

  • All Work—including artwork, physical products, videos, courses, sessions, writings, and programs—is based on personal experience, creative practice, professional insight, and self-guided learning.

  • The Work is educational, informational, or artistic in nature and does not constitute professional advice.

  • We are not licensed therapists, medical professionals, legal advisors, financial advisors, or formally accredited teachers, unless explicitly stated in writing.

  • Nothing offered through the Work constitutes medical, legal, financial, psychological, or therapeutic advice.

You remain solely responsible for your decisions, interpretations, actions, and outcomes.

3. Relationship of the Parties & Studio Conduct

Your engagement with this studio does not create an employer–employee relationship, partnership, joint venture, fiduciary duty, or therapeutic relationship. The relationship is that of an independent creator and client.

Engagement with this studio is entered into on the basis of mutual respect and good-faith participation. By accessing, purchasing, commissioning, or participating in any Work, you agree to communicate respectfully and to maintain reasonable expectations consistent with the nature, scope, and timelines of an independent creative practice.

Communication or conduct that is coercive, shaming, harassing, or that attempts to control the creator beyond the agreed scope, process, or stated terms is considered a violation of these Terms.

We reserve the right, at our discretion, to pause, decline, or terminate an engagement where such conduct occurs, without refund, while remaining bound to any applicable consumer protection laws.

4. No Guarantees

While all Work is delivered with care, professionalism, and integrity:

  • Outcomes and results are not guaranteed.

  • Individual results vary widely based on personal circumstances, timing, effort, and external conditions.

  • Testimonials, examples, or prior outcomes are illustrative only and do not constitute promises.

5. Artwork, Physical Products & Commissions

Ready-to-Purchase Physical Artwork & Products

  • This includes original artwork, limited editions, prints, or other tangible goods made available for purchase.

  • All physical products are sold as described at the time of purchase.

  • Colour, texture, and scale may vary slightly due to screen settings and the handmade or artistic nature of the Work.

  • Unless otherwise stated, all sales are final and non-refundable, except where required by applicable consumer protection law.

Shipping & Delivery

  • Shipping timelines are estimates and not guaranteed.

  • Risk of loss or damage transfers to the buyer upon shipment.

  • We are not responsible for delays, loss, or damage caused by carriers, customs, or circumstances beyond our control.

  • Any customs duties, taxes, or import fees are the responsibility of the buyer.

Commission-Based Artwork

  • Commissioned Work involves significant creative labour, time allocation, and bespoke direction.

  • All deposits and payments are non-refundable, including if the client changes direction, withdraws, or no longer wishes to proceed.

  • Timelines are estimates and may shift due to creative process, health, or unforeseen circumstances.

Unless otherwise agreed in writing, copyright remains with the creator. Limited usage rights may be granted by separate written agreement.

6. Programs, Consulting, Sessions & Contracted Work

This includes, but is not limited to:

  • Strategy or advisory sessions

  • Creative or business consulting

  • Programs, containers, or project-based engagements

  • Digital or in-person Work

Scope & Deliverables

  • Deliverables are defined by access, time, and participation, not by specific outcomes.

  • Unless explicitly stated in writing, Work does not promise:

    • Financial results

    • Business growth

    • Emotional outcomes

    • Creative success

  • Additional requests beyond the agreed scope may require additional fees.

Payment & Refund Policy

All payments for any Work — including artwork, commissions, physical products, digital products, subscriptions, programs, workshops, sessions, or other participatory offerings — are non-refundable, except as required by applicable consumer protection law or where a specific refund policy is clearly stated for the relevant Work.

This policy ensures clarity and fairness: it protects the studio from lost resources and time, while also protecting clients from misunderstandings, mis-commitments, or changes in schedule or circumstances that may arise during the creation, delivery, or participation of the Work.

Payments are considered final once access is granted, services begin, or a commission is initiated. If a payment plan is offered, it remains payable in full regardless of participation, engagement level, or perceived results.

7. Digital Products, Courses, Video Libraries & Subscriptions

One-Time Digital Products

  • Access is granted for personal, non-commercial use only.

  • Sharing, copying, distributing, or reselling content is prohibited.

  • Due to the digital nature of these products, no refunds are provided.

Subscriptions (Video Banks, Memberships)

  • Subscriptions provide ongoing access to Work on a recurring billing basis.

  • By subscribing, you authorize automatic recurring charges until cancellation.

  • You may cancel at any time to prevent future charges; past payments are non-refundable.

  • Content may evolve, be added, modified, archived, or removed over time.

  • No minimum volume, frequency, or permanence of content is guaranteed unless explicitly stated.

  • Subscribers are encouraged to review the Terms before purchase to ensure understanding of access and cancellation policies.

8. Patronage & Support-Based Offerings

Some offerings may be presented as patronage, supporter, or contribution-based Work.

  • Patronage payments are voluntary and non-refundable.

  • Patronage supports the continuation of creative and educational Work.

  • Benefits, if offered, are discretionary and may change or be discontinued.

  • Patronage does not constitute a commercial service agreement unless explicitly stated.

9. Intellectual Property

All Work—including artwork, videos, audio, text, frameworks, designs, and branding—is the intellectual property of the creator and protected under Canadian copyright law. You may not reproduce, distribute, modify, or commercially exploit any Work without prior written consent.

10. Accessibility & Technology Disclaimer

Reasonable efforts are made to provide an inclusive and respectful experience. However:

  • The website and Work may not be fully accessible to all individuals or technologies.

  • Work is provided on an "as available" basis.

If you experience accessibility barriers, you are encouraged to contact us so reasonable accommodations may be explored where feasible.

11. Assumption of Risk

You acknowledge that engaging in creative, professional, or personal development Work may involve emotional, financial, or psychological challenges and voluntarily assume full responsibility for your participation.

12. Limitation of Liability

To the fullest extent permitted by law:

  • We shall not be liable for any direct, indirect, incidental, consequential, or special damages.

  • This includes loss of income, business opportunities, data, reputation, or emotional distress.

Your sole remedy for dissatisfaction is to discontinue engagement with the Work.

13. Indemnification

You agree to indemnify and hold harmless the creator from any claims, losses, damages, or legal expenses arising from:

  • Your use or misuse of the Work

  • Your violation of these Terms

  • Your reliance on any information provided

14. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of the website constitutes acceptance of the revised Terms.
